Welcome to Ann Owen Art. "We", "us" and "our" refer to Ann Owen Art. We operate this store and website, including all related information, content, features, tools, products and services, to give you, the customer, a curated shopping experience (the "Services").

Our store is powered by Shopify, which enables us to provide the Services to you. These terms and conditions, together with any policies referenced here (these "Terms"), describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, you shouldn't use or access our Services.

1. Access and account

By agreeing to these Terms, you confirm that you're at least the age of majority in your state or territory of residence. To use the Services — including browsing our store or buying any artwork — you may be asked to provide information such as your email address, billing, payment and shipping details. You confirm that all information you provide is correct, current and complete.

2. Our artworks

Every piece is an original, one-of-a-kind watercolour — no two are exactly alike, and once a piece sells, it's gone. We've made every effort to represent colours and detail accurately online, but screen settings vary, so actual colours may differ slightly from what you see on your device.

Artwork descriptions and availability are subject to change at any time, at our discretion.

3. Orders

When you place an order, you're making an offer to purchase. We may accept or decline your order at our discretion, and it isn't confirmed until we accept it. Because each piece is one-of-a-kind, please review your order carefully — we may be unable to accommodate cancellations once an order is accepted for original artwork.

Your purchases are subject to our Refund & Returns Policy.

4. Prices and billing

Prices are subject to change without notice. The price charged is the price shown at the time you place your order, as confirmed in your order confirmation email. Posted prices include GST but don't include shipping, handling or any customs or import charges for international orders.

You confirm that the payment information you provide is true, correct and complete, and that you're authorised to use the payment method provided.

5. Shipping and delivery

Delivery times are estimates only and aren't guaranteed. We're not responsible for delays caused by shipping carriers, customs processing or events outside our control. See our Shipping Policy for timeframes, costs and free shipping eligibility.

6. Intellectual property

Every piece of artwork on this site is Ann Owen's copyright and her livelihood. These Terms let you use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any artwork or content on the Services without prior written consent.

7. Commissions

Commission enquiries are welcome — please get in touch via hello@annowen.com.au to discuss your idea. Commissioned pieces are made specifically for you and are non-refundable for change of mind once work has commenced, though the guarantees under the Australian Consumer Law still apply.

8. Third-party links

The Services may contain links to third-party websites. We're not responsible for their content, accuracy or your use of them.

9. Relationship with Shopify

Our store is powered by Shopify. Any sales made through this store are made directly with Ann Owen Art. Shopify isn't responsible for any aspect of the sale, including any injury, damage or loss resulting from products purchased.

10. Privacy

All personal information collected through the Services is subject to our Privacy Policy.

11. Your rights under the Australian Consumer Law

Our artworks come with guarantees that can't be excluded under the Australian Consumer Law. For a major failure, you're entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law.

12. Disclaimer of warranties

Subject to Section 11 and to the fullest extent permitted by law, the Services and artworks are provided "as is" and "as available" without warranties of any kind beyond those guaranteed under the Australian Consumer Law.

13. Limitation of liability

Subject to Section 11 and to the fullest extent permitted by law, Ann Owen Art is not liable for any indirect, incidental or consequential damages arising from your use of the Services. Nothing in this section limits any liability that can't be excluded under the Australian Consumer Law.

14. Governing law

These Terms are governed by the laws of the Northern Territory, Australia. You and Ann Owen Art submit to the non-exclusive jurisdiction of the courts of the Northern Territory.

15. Changes to these Terms

We may update these Terms from time to time by posting the revised version to this page. Your continued use of the Services after changes are posted means you accept those changes.
